Terms of Service

These Terms of Service ("Terms") govern your purchase and use of the Borrower Experience Review and related engagements ("Services") provided by Smart Chic Systems, Inc. ("Smart Chic Systems," "we," "us"). By purchasing an engagement, you agree to these Terms on behalf of your institution.
1. The Services
The Borrower Experience Review is a diagnostic engagement. We evaluate your institution's public digital funnel and, where access is provided, your lending application from a well-qualified borrower's perspective, and we deliver a written Signal Report and a narrated video. The full Borrower Experience Review also includes a live debrief and a prototype preview.
The Services are diagnostic only. They do not include implementation, redesign, development, or build work, which are separate engagements arranged under a separate agreement.
2. Fees and Payment
Engagements are offered at a fixed fee, stated at checkout. Payment is processed through our third-party payment processor (Stripe) and is due in full before work begins. We do not store your full card details. There is no retainer and no ongoing commitment.
3. Delivery and Timeline
We deliver the Signal Report and narrated video within 21 business days of the confirmed start date. The delivery clock starts when both payment is received and all access conditions are met. If sandbox credentials take five or more business days to arrive after your scope agreement is signed, the clock starts on the day credentials arrive. The live debrief (Borrower Experience Review) is scheduled within 10 business days of report delivery, subject to your team's availability.
4. Your Responsibilities
- Provide accurate contact and institutional information.
- Where a full walkthrough is purchased, provide sandbox or test-environment credentials through the secure process we supply. You confirm you are authorized to grant this access.
- If a sandbox is not available, we proceed through your live application up to the point a credit pull, document request, or compliance event would trigger, and that stopping point is documented as a finding.
5. Credential Security and Data
Credentials you provide are transmitted encrypted, stored in a role-restricted vault accessible only to the assigned analyst for the duration of the walkthrough, and destroyed within 24 hours of completion, with written confirmation. Recordings are private, password-protected, and not downloadable. Our handling of your information is described in our Privacy Policy.
6. Deliverables and Intellectual Property
On full payment, you own the findings delivered in your Signal Report and may share them internally with your leadership team. The methodology, frameworks, templates, and any prototype shown in the debrief remain the property of Smart Chic Systems. The prototype is shown for illustration only and is not delivered, licensed, or provided as a design specification.
7. No Guarantee of Results
Our findings and any revenue figures, ranges, or calculator outputs are directional estimates based on the experience and on assumptions you provide. They are not a guarantee of recovered volume, revenue, or any specific outcome.
8. Refunds
If the Signal Report and narrated video are not delivered within 21 business days of the confirmed start date, you may request a full refund. The guarantee covers delivery, not agreement with the findings. Refunds are not issued because of disagreement with conclusions, and the guarantee does not apply to the debrief scheduling timeline, which depends on your availability.
9. Confidentiality
Each party will protect the other's non-public information and use it only to perform or receive the Services. We will not disclose your institution's specific findings to third parties without your consent, except as required by law.
10. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of the Services is limited to the fees you paid for the engagement giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state or federal courts located in Texas.
12. Changes to These Terms
We may update these Terms from time to time. The version in effect on the date of your purchase governs that engagement.
